1. Scope of Activities

YERP is a platform for planning and participating in outdoor activities, including but not limited to:

• Camping, climbing, hiking, mountain biking, water sports, track riding, off-roading, and more.
• By using YERP, you acknowledge that these activities inherently involve risks, including physical harm, equipment damage, weather conditions, and interactions with strangers.

2. Geographical Use

YERP operates within the United States. These Terms of Use will be updated for compliance with international laws when YERP expands to other countries.

3. Eligibility and Age Restrictions

• Users must be 18 years or older to create a profile.
• Minors may only participate under a guardian's account and must be individually accounted for in each event.

4. Acknowledgment of Risks

By using YERP, you agree to:

• A blanket acknowledgment of inherent risks associated with all supported activities.
• Detailed acknowledgment of risks, including but not limited to:
  • Physical injury or death.
  • Property damage or theft.
  • Adverse weather or environmental conditions.
  • Risks of meeting and relying on strangers for activities.

5. Prohibited Behaviors

Users agree to:

• Abstain from engaging in illegal activities, including but not limited to the use of illegal substances.
• Avoid unsafe practices and discriminatory behavior.
• Cooperate with YERP in cases of investigation or legal action involving user behavior.
• Accounts involved in prohibited behaviors may be suspended or terminated.
• YERP reserves the right to share user information with law enforcement when necessary.

6. User Agreement on Gear and Safety

Users acknowledge that:

• They are solely responsible for inspecting their gear and ensuring it meets industry safety standards.
• All gear must be within certification dates and in good working condition.

7. Host Responsibilities

Hosts are required to:

• Provide detailed information about their events, including skill level, required gear, and safety precautions.
• Acknowledge they are not professionals or guides and assume no responsibility for the safety of participants.

8. User Agreement Renewal

• Users must acknowledge and sign an updated Terms of Use agreement annually on January 1st.
• A summary of changes will be provided before requiring a signature.

9. Arbitration and Disputes

• Any disputes arising from the use of YERP must be resolved through binding arbitration in lieu of court proceedings.
• Arbitration will occur under the rules of [Insert Arbitration Organization].

10. Data Privacy and Usage

YERP's data collection and usage practices are outlined in a separate Privacy Policy. By agreeing to these Terms of Use, you also agree to the Privacy Policy.

11. Emergency Situations

Users are solely responsible for their emergency preparedness, including:

• Carrying first aid kits.
• Knowing local emergency numbers and procedures.

12. Indemnity Clause

You agree to indemnify and hold harmless YERP, its founders, and hosts from any claims, damages, or lawsuits arising from your use of the platform or participation in activities.

13. Termination of Use

YERP reserves the right to suspend or terminate accounts for:

• Violations of these Terms of Use.
• Engagement in prohibited behavior.

14. Acknowledgment and Agreement

By creating a profile or continuing to use YERP, you acknowledge that you have read, understood, and agreed to these Terms of Use. Failure to comply with these terms may result in suspension or termination of access to the platform.
